Terms of Use
These Terms of Use (“Terms”) govern your use of the Famreco application and its related websites, sharing, synchronization, support, and other features (collectively, the “Service”) provided by the operator of Famreco (“Operator,” “we,” “us,” or “our”).
Please review these Terms and our Privacy Policy before using the Service. By using the Service, you agree to these Terms.
1. Scope of These Terms
These Terms apply to all relationships between you and the Operator relating to your use of the Service.
Explanations, notices, guidelines, and other specific conditions displayed within the Service or on related websites form part of these Terms.
If a specific condition conflicts with these Terms, the specific condition will prevail unless otherwise stated.
2. Device Requirements and Apple Account
Certain features of the Service may require a compatible Apple device, a supported operating system, internet access, an Apple Account, and an available iCloud environment.
You are responsible for properly managing your device, Apple Account, authentication information, device passcode, and other elements of your access environment.
Some or all features may become unavailable because of a lost device, unauthorized device access, changes to Apple Account settings, insufficient iCloud storage, connectivity problems, or other circumstances outside our control.
3. Creating Albums and Sending Invitations
You may create private albums for sharing memories with family, friends, and other people close to you, and you may invite other users to those albums.
Before sending an invitation, you must confirm that the intended recipient is appropriate. You must not publish an invitation link publicly or share it with unintended recipients or an unrestricted audience.
Anyone receiving an invitation should confirm the sender and the intended album before joining.
We cannot technically guarantee that invitation links will never be forwarded, misdirected, viewed, or used by an unintended person.
4. Members and Permissions
An album owner or another authorized member may be able to invite members and change viewing, posting, participation, and other permissions.
A permission change, removal from an album, cancellation of participation, or similar action may prevent a user from accessing all or part of an album.
Before joining, posting, or sharing content, you should confirm your permissions and the people with whom the album is shared.
5. User Content
You may add or post photos, videos, text, display names, profile images, comments, reactions, tags, and other information (“User Content”) through the Service.
You are responsible for ensuring that you have all rights, permissions, and consents necessary to upload, store, use, and share your User Content through the Service.
You or the applicable rights holder retain ownership of all copyrights and other rights in User Content.
You permit us and the Service to technically process User Content only to the extent necessary to provide, store, synchronize, share, display, back up, restore, secure, and improve the Service.
6. Information About Children and Other People
If you add a name, photo, video, profile, or record relating to a child, family member, friend, or any other person, you are responsible for obtaining any consent required from that person, a parent or guardian, or another applicable rights holder.
You should carefully review the content, sharing scope, and album members to avoid infringing another person’s privacy, publicity, reputation, or other rights.
7. Important Notice About Private Sharing
Famreco is intended for sharing memories among invited members, rather than for public distribution to an unrestricted audience.
However, we cannot technically prevent an album member from saving content to a device, taking screenshots, recording a screen, forwarding content, reposting content, or otherwise using content outside the Service.
You are responsible for inviting only people you trust and for deciding what content is appropriate to share.
8. iCloud and CloudKit
The Service may use Apple’s iCloud, CloudKit, and related services to store, synchronize, share, and restore data.
Your use of iCloud and CloudKit is also subject to Apple’s terms, the status of your Apple Account, your iCloud settings, available storage, internet connectivity, and other applicable conditions.
Synchronization, sharing, storage, or restoration may be delayed or unavailable because of an Apple service interruption, settings change, storage limitation, network problem, operating system change, or another circumstance beyond our reasonable control.
9. Paid Features and Premium
The Service may offer paid features through subscriptions, one-time purchases, or other in-app purchases.
The available features, billing period, price, free-trial terms, automatic renewal conditions, and other purchase details will be shown on the applicable purchase screen.
Purchases, billing, renewals, cancellations, and refunds made through the App Store are governed by Apple’s applicable terms and procedures.
Cancelling a subscription may stop future renewals while allowing access to paid features until the end of the active billing period shown by Apple.
Except where required by applicable law or available through Apple’s procedures, we may be unable to independently process an App Store purchase or refund.
10. Prohibited Conduct
You must not engage in any of the following conduct in connection with the Service:
- Violating any applicable law or public policy.
- Infringing another person’s copyright, image or publicity rights, privacy, reputation, or other rights or interests.
- Posting or sharing another person’s information or content without any consent or permission that is required.
- Providing false information, impersonating another person, committing fraud, or presenting misleading information.
- Threatening, harassing, discriminating against, defaming, or otherwise harming another person.
- Posting unlawful, harmful, obscene, violent, or rights-infringing content.
- Using invitation links or sharing features for spam, unsolicited distribution, advertising, commercial solicitation, or another purpose unrelated to private album sharing.
- Placing an excessive load on the Service, its servers, networks, or other users.
- Attempting unauthorized access, unauthorized collection of data, alteration, reverse engineering, analysis, or circumvention of a security feature.
- Interfering with, disrupting, or attempting to disrupt the operation of the Service.
- Engaging in any other conduct that we reasonably determine to be inconsistent with the intended purpose of the Service.
11. Data Management and Deletion
You may be able to change or delete posts, albums, profiles, comments, participation status, and other data by using features provided within the application.
Deleting an album, leaving an album, deleting the application, or changing an Apple Account may make data stored on a device or in iCloud unavailable.
Deleting data from a shared album may also affect its availability to other album members.
You should maintain your own appropriate copy of any important photos, videos, or other data when necessary.
12. Access Restrictions and Removal
We may restrict or suspend all or part of your access to the Service without prior notice if you violate these Terms, create a security risk, may cause material harm to another user or the Service, or if restriction is otherwise reasonably necessary.
An album owner or another authorized member may be able to remove a member from an album.
13. Changes, Suspension, and Discontinuation
We may change, suspend, or discontinue all or part of the Service for feature improvements, maintenance, incident response, security, legal compliance, changes to Apple services or specifications, or other operational reasons.
Where a change or discontinuation is expected to have a significant effect on users, we will provide advance notice through this page, the application, or another appropriate method to the extent reasonably possible.
14. Disclaimer of Warranties
We do not guarantee that the Service will always be secure, reliable, accurate, complete, suitable for a particular purpose, continuously available, compatible with every device or environment, free from errors or interruptions, or capable of preventing every loss of data.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.
15. Limitation of Liability
Except in cases of our willful misconduct or gross negligence, our liability for loss arising from the use of or inability to use the Service will be limited to the extent permitted by applicable law.
Where we are liable for ordinary negligence, our liability will, to the extent permitted by applicable law, be limited to ordinary and direct damages.
Nothing in this section excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable consumer protection or other law.
16. Third-Party Services
The Service may interact with third-party services provided by Apple and others, including the App Store, iCloud, CloudKit, StoreKit, system sharing features, and messaging services such as LINE.
Your use of a third-party service is subject to the terms and privacy policy of its provider.
A change, interruption, or discontinuation of a third-party service may make some Famreco features unavailable.
17. Changes to These Terms
We may update these Terms when reasonably necessary because of a change in law, a change to the Service, security requirements, or another legitimate reason.
If we make a material change, we will provide notice of the change and its effective date through this page, the application, or another appropriate method.
Updated Terms become effective on the date they are posted or on another effective date stated in the applicable notice.
18. Severability
If any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect.
19. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of Japan.
If a dispute arises in connection with the Service or these Terms, the parties will first attempt to resolve it through good-faith discussion.
If the dispute cannot be resolved through discussion, the courts of Japan having jurisdiction over the Operator’s principal location will have exclusive jurisdiction as the court of first instance, to the extent permitted by applicable law.
